1. Data controller

The data controller for personal data collected on this website and through its forms is Esev Kardeşler Deniz Hizmetleri Tic. Ltd. Şti. (the “Company”).

2. Personal data we process

The data we process depends on how you contact us:

  • Contact and quote form: your name, phone number, email address (optional), your message and the job details you enter (service type, ship or vessel name, location, date, subject).
  • Transaction security: the IP address from which the form was sent, the time of sending, the form language and the tick box confirming you have read this notice.
  • Phone, WhatsApp and email: the name, contact details and message content you send through these channels.
  • Job applications: the information you give in the application form or by email (name, contact details, the position you apply for, years of experience, certificate of competency, vessel types you have worked on, where you live, when you can start) and your CV and the information in its attachments (education, experience, certificates, etc.).
  • Use of the site: technical information needed for the site to work (a session cookie, the IP address sent by your browser and server logs).

3. Purposes of processing

  • To assess your quote and information requests, reply to you and plan the service,
  • To carry out the correspondence needed to conclude and perform a service contract,
  • To assess job applications,
  • To keep the site and its forms secure and prevent unwanted and automated (spam) submissions,
  • To meet our legal obligations and respond to requests from competent authorities,
  • To protect our rights in the event of a dispute.

4. Legal grounds and method of collection

Your personal data is collected through the forms on this site, by phone, WhatsApp and email, by fully or partly automated means, and processed on the following legal grounds under Article 5 of the KVKK:

  • Processing is directly related to concluding or performing a contract (Art. 5/2-c): quote and service requests, job applications,
  • Processing is necessary for the data controller to meet a legal obligation (Art. 5/2-ç): statutory retention and reporting duties,
  • Processing is necessary to establish, exercise or protect a right (Art. 5/2-e): possible disputes,
  • Processing is necessary for the data controller’s legitimate interests, provided your fundamental rights and freedoms are not harmed (Art. 5/2-f): site and form security, IP logs.

We do not carry out any processing based on explicit consent in this context. The tick box on our form is there for you to confirm that you have read this notice.

5. Transfers of personal data

We do not share or sell your personal data to third parties for marketing. Data may be disclosed only to public authorities legally entitled to request it, within the limits of a legal obligation. The providers of our website hosting and email services can access data only as technically required to provide those services.

6. Retention period

Contact and quote form records are kept for as long as needed to handle your request and any dispute, and in any case for no more than 2 years. Correspondence that leads to a service relationship is kept for the periods set by law (e.g. 10 years for commercial books and records under the Turkish Commercial Code). Unsuccessful job applications are kept for no more than 1 year. At the end of the period, data is erased, destroyed or anonymised.

7. Your rights (KVKK Art. 11)

By applying to our Company you can exercise the following rights regarding your personal data:

  1. To learn whether your personal data is processed,
  2. To request information about the processing if it is,
  3. To learn the purpose of processing and whether data is used for that purpose,
  4. To know the third parties in Türkiye or abroad to whom data is transferred,
  5. To ask for incomplete or inaccurate data to be corrected,
  6. To ask for data to be erased or destroyed under the conditions in Article 7 of the KVKK,
  7. To ask for corrections, erasure or destruction to be notified to third parties to whom data was transferred,
  8. To object to a result against you arising from analysis of the data exclusively by automated systems,
  9. To claim compensation if you suffer damage because of unlawful processing.

8. How to apply

You can send requests about your rights, with information to verify your identity, by email to info@esevkardesler.com or in writing to our company address. Under the Communiqué on the Procedures and Principles of Applications to the Data Controller, your request will be concluded free of charge within 30 days at the latest; if the action involves an additional cost, the fee set by the Personal Data Protection Board may apply.

9. Cookies

Our site uses only one cookie that is strictly necessary for it to work: a session cookie. It is needed for form security (CSRF protection) and to remember your language, and it is deleted when you close your browser. We do not use advertising or personalisation cookies.

Our pages load some font and library files, and the map on the contact page, from third-party providers (e.g. jsDelivr, Google); in doing so your IP address is technically passed to these providers.

10. Changes

We may update this notice to reflect changes in the law or in how we process data. The current version is always published on this page.
